Miller’s Creek Marina Development – Fort Erie, Ontario

The Niagara Parks Commission (the “NPC”) would like to announce its intention to enter into a competitive process for services related to the Miller’s Creek Marina Development, Fort Erie, Ontario.

Currently, the NPC is determining the specific procurement approach but expects to post on the NPC Vendor website ( http://www.niagaraparks.com/vendor/bid-opportunities.html ) and MERX© ( www.MERX.com/niagaraparks ) a Request for Proposals (RFP) or a Request for Qualifications (RFQ) followed by an invitational RFP in the late Summer/Fall of this year. Due to this uncertainty about the specific procurement approach, we have referred to the procurement document below as an “RFX”.

Stakeholder Consultation Sessions

In order to prepare for the procurement, the NPC will be offering stakeholder consultation sessions in which local interest groups will be invited to attend a consultative session. Some of these stakeholders include:

  • Hotel, motel and other accomodation service providers;
  • Restaurant, food and other related service providers;
  • Other hospitality providers;
  • Tour companies, ticket agencies and other related travel services;
  • Entertainment and other local attractions;
  • Retailers, manufacturers and distributors of novelty items;
  • Local community interest groups; and
  • All other general and special interest groups.

The consultations are intended to be information sharing sessions where the NPC will provide information on the following:

  • A summary of the proposed procurement process; and
  • Procedures that have been put in place to ensure the processes are open, fair and transparent.

As a means to ensure the process takes into account local interest and concerns, the NPC will be asking the participants to provide information and insight into potential opportunities and issues associated with this initiative during the consultation.

Once the arrangements for the consultation have been determined, an e-mail will be sent to all respondents with a date, location and other relevant information. In the event a stakeholder is not able to attend the session, we will put in place a process for such groups to provide a written submission.

Proponents Information Session

The NPC will also be arranging to meet with potential bidders in a separate set of one-on-one group (not individual) consultations. These sessions will include a tour of the site, together with access to information related to the proposed marina development. Given the confidential nature of the information that will be provided, any potential bidder who wishes to participate will be required to sign a non-disclosure agreement. Part of the agreement will be rules of engagement that outline requirements related to confidentiality, disclosure of information, plus standards pertaining to influence and lobbying.

Once the arrangements for these sessions have been determined, an information package will be e-mailed to each respondent with details on dates and location. The information package will include an invitation to respondents to attend a one-on-one meeting with the NPC procurement team, a copy of the Non-Disclosure Agreement and the Rules of Engagement. See below (under ‘Fairness Measures’) for more information on these documents and their requirements.

In the event a stakeholder is not able to attend the session, we will put in place a process to provide a written submission. It should be understood that potential bidders are eligible to register for both stakeholder consultations sessions as well as the proponent information sessions if they so choose.

Fairness Measures

Given the level of interest in this procurement and the subsequent sensitivities, the NPC is in the process of retaining the services of a Fairness Commissioner. The Fairness Commissioner will put in place measures designed to help ensure the procurement process is open, fair and transparent. Such measures have already been implemented for all NPC employees and Commissioners.

The Fairness Commissioner will also require that all bidders who are interested in attending a one-on-one meeting with the NPC procurement team sign a Non-Disclosure Agreement (NDA). The purpose of the NDA is to ensure any information shared in these meetings is held in confidence. If a bidder elects not to sign the NDA, they will not be invited to attend a one-on-one meeting but can still bid on the RFX when it is posted.

The Fairness Commissioner has also established Rules of Engagement (ROE) which introduces some standards related to bidder influencing and lobbying. The purpose of the ROE is to establish some parameters around what is and is not allowed in terms of contact with NPC staff, using the media for self-promotion or for influencing public opinion on the process or applying pressure to the NPC, NPC staff or NPC Commissioners. If a bidder elects not to sign the ROE, they will not be invited to attend a one-on-one meeting but can still bid on the RFX when it is posted

Tender Title: Aero Car Sewage System Upgrade

This Request for Proposals ("RFP") is an invitation to prospective proponents to submit proposals for the provision of a Sewage System Upgrade at NPC’s Aero Car attraction as further described in Part 2 - The Deliverables (the “Deliverables"). This RFP is issued by The Niagara Parks Commission (NPC) and is a Provincial Crown Agency and a corporation incorporated by an Act of the Provincial Legislature of Ontario on the 23rd of April 1887 and continued under the Niagara Parks Act. R.S.O. 1990, Chapter N3.

Part 2 - The Deliverables

2.1 Scope of Work

The Niagara Parks Commission (“NPC”) has issued this Request for Proposals (“RFP”) to secure a contractor to replace existing sanitary sewer as further described in this RFP’s Scope of Work (Appendix “A”) and Drawings (Appendix “G”).

2.2 Description of Deliverables

2.2.1 RFP Award Completion Date:

The award of this tender is subject to the Owner obtaining approval from City of Niagara Falls. Tentatively, construction may commence, but is not guaranteed, by June 14th, 2013. All works shall be complete by as soon as possible. There shall be no work on weekends or holidays that occur in that time period.

2.2.2 Additional Insured

The following parties are identified to be included as additional insured for this project:

The Niagara Parks Commission, Corporation of the City of Niagara Falls and Kerry T. Howe Engineering Limited.

2.2.3 Project Work Schedule / Traffic Control Plan

Work shall be completed as soon as possible. The forcemain installation and piping and structure modifications in the crawl space shall commence while the tank and pump is being processed by the supplier. The final sewage transfer to the forcemain shall be completed after the pumps are received and installed for use.

During construction of the forcemain the contractor shall allow maintenance crews hired by the Parks immediate access to clear the existing gravity sewer should the system plug from operations at the attraction.

The awarded firm shall provide a traffic control plan for maintaining traffic on the Niagara Parkway throughout the construction project. The plan shall meet the approval of the NPC traffic section and the City of Niagara Falls.

2.2.4 Materials from John Brooks Company Limited

The NPC have preselected the pumps, pump controls and tank to be used on the project. Appendix J lists the quote for the materials to be supplied, with details of the system. The pumps are EONE grinder pumps with a sanitary duplex controller 60” diameter and 60” high FRP tank and aluminum hatch cover.

The material is pre-ordered to reduce delivery time. The successful proponent will take over the order and pay John Brooks for the materials supplied. NPC will pay the Contractor the sales amount upon verification all materials were delivered to the site. The successful Contractor will not receive additional payment for item 1 of the tender until the contractor produces a statement from John Brooks indicating they have received payment for the material supplied.

2.2.5 Other Materials and Equipment Required for the Work

All other materials, equipment and plant required to complete the works shall be supplied by the selected contractor. All associated costs shall be included in the applicable lump sum price bid.

2.2.6 Plumbing Permit

The Contractor shall obtain all necessary plumbing permits from the City of Niagara Falls and pay the costs. The owner will supply any necessary prints of drawings prepared for tender for the Contractor to obtain the permit. All costs shall be included in the applicable bid items.

2.2.7 Electrical Inspections and Permits

The successful Contractor will obtain all necessary permits and inspections to obtain approval for the electrical installations required for the works.

2.2.8 Open Cut Works

The forcemain shall be installed by open cut methods in the general location noted on the drawing. The maximum depth required is 1.0 m to underside of bedding. Where the depth to trench bottom does not provide 0.5 m. cover over a 50 mm insulation inverted U rock removal to provide that cover or the 1.0 m. trench depth shall be completed by hoe ram. The contractor shall include mobilization and demobilization of the hoe ram equipment in the lump sum price of the 50 mm pipe installation item. Once the hoe ram is required on site it shall remain until the forcemain trench is completed. The rock removal and insulation price will be paid from the allowance items. No credit will be requested for mobilization or demobilization should the hoe ram not be required during the project.

Mandatory Site Visit:

NPC will hold a MANDATORY Site Visit with potential proponents. The Site Visit will be held on June 3, 2013 @ 10:00 am. Proponents are asked to meet at Niagara Parks’ Aero Car: approx. 3850 Niagara Parkway, Niagara Falls, ON. This will be the only site visit period within the basement and fenced areas at the complex. All areas requiring access for construction will be open for review at that time. The Proponent may view the sanitary forcemain installation west of the existing wall at any time during the tender period.

Part 2 - The Deliverables

2.1 Scope of Work

The Niagara Parks Commission (“NPC”) has issued this Request for Proposals (“RFP”) to secure a maximum of three (3) vendors to enter into a three (3) year contract for Window, Door, Eaves, Soffit and Siding replacement, installation, maintenance, cleaning and related service work requiring certified workers employed by a qualified firm to the NPC. Term of this engagement will be for a period of three (3) years.

Suppliers will be ranked from one (1) to three (3) based on the evaluation criteria points they achieve (Appendix E – Rate Criteria).  In the event that the number one (1) ranked supplier cannot provide the product or service, the number two (2) ranked supplier will be offered the order and if the number two (2) ranked supplier cannot provide the product or service the number three (3) ranked supplier will be offered the order. The NPC reserves the right to arrange for service work from any of the three (3) successful vendors.

Suppliers selected as vendors of record will be required to participate in the Niagara Parks Commission’s Contractor Health & Safety Orientation Program. This program is a mandatory requirement for the NPC’s designated Vendor or Record program. Upon successful completion of the program, suppliers will be awarded with an agreement (sample attached as Appendix F) to provide services to the NPC. No more than three (3) representatives from each firm may attend. At this meeting, suppliers will be provided with reference material to take with you.

Please note that it is mandatory at least one supervisor and/or manager attends the Contractor Health & Safety Orientation Program. It is optional for the selected suppliers to have trades personnel attend however; NPC is not to pay your firm for attending this orientation session. The safety information obtained at the session should be relayed from your firm’s supervisors/managers in attendance to their respective trades personnel prior to commencing work on NPC property/buildings.

2.2 Description of Deliverables

  • The specific deliverables of the engagement include the following:
  • Provide 24 hour and after hours / emergency service – as required.
  • Identify response time from a NPC staff service call in minutes at a maximum of 60 minutes.
  • State labour & materials warranty details and warranty time at a minimum of a one year warranty period
  • Provide firm 3-year pricing (2013 – 2016) for items identified below inclusive of all labour, materials, travel, and equipment.
  • Work, Service and Projects shall generally consist of, but not limited to all window, door, eaves, soffit, and siding replacement, installation, maintenance, cleaning and related work.
  • Contractors must have all applicable and current licenses, certificates, and all other qualifications as per all government legislation and all other regulatory requirements. NPC is to be immediately notified if there has been change in a worker’s status or certifications. The successful contractor(s) must have the following minimum certifications, but not limited to:
    • Aerial lift certification
    • Must have fall arrest certified
    • WHIMIS training
    • Must be certified to work in commercial, industrial and institutional environments
    • Must have lock-out procedural training when necessary
  • Provide original invoices for part costs for verification purposes
  • Follow the required protocol outlined below:
    • Following all work, a Service Report must be completed detailing all work, materials and/or parts used, number of workers and total hours worked, to be signed by the Niagara Parks Commission representative(authorizing coordinator)
    • Invoices submitted to NPC for work performed must have a copy of the Service Report including the number of hours worked per worker, all materials/parts costs and must have copies of materials/parts invoices attached (please see sample Contractor’s Daily Work Record – Appendix I).
    • Provide valid and current copies of the following for each worker:
      • Certificates and Qualifications in accordance with the Ontario College of Trades & Qualifications Act, 2009 (OCTAA)where applicable
      • All applicable & current licences, certificates and all other qualifications per all government legislation and other regulatory requirements
      • Copies for each worker must be attached to the bidder’s quotation submission. NPC is to be immediately notified if there has been a change in a worker’s status or certifications
  • Provide the names / contact information and the work to be performed by any / all sub-contractors and persons for the execution of all work and services as described which shall not be performed directly by the contractor or the contractor’s employees.
    • Notes:
      • The Niagara Parks Commission reserves the right to accept or reject any sub-contractors or persons named below.
      • Any quotation submitted that does not include this form may be rejected by the Niagara Parks Commission.
  • Meet all applicable health, safety and environmental laws and regulations.
  • Submit to NPC the following documentation for vendor and any/all subcontractor’s (if applicable):
    • a completed “NPC Health and Safety Contractor Pre-qualification Questionnaire” and supporting documents (see attached);
    • Proof of good standing with the Ontario Workplace Safety and Insurance Board (WSIB) (i.e. WSIB clearance certificate);
    • Injury statistics reports from the WSIB for the last three (3) years.
  • Site Safety and Security – the Contractor shall be responsible for the safety and security of the work areas from the public. Erection of barriers, fencing, caution tape, notices, signage, etc., or other means of safety measures shall be undertaken where necessary for public safety.
  • The contractor is to ensure his forces are working safely and with courtesy to NPC staff and visitors, especially during operations that require equipment and workers to work on Niagara Parks property.
  • Inspections, Permits, and Approvals – The Contractor is responsible for arranging and obtaining all necessary inspections, permits and approvals, and underground utility locates for various works as well as any associated costs.
  • Lay out for all required contract elements is the responsibility of the contractor.
  • Weekend or after-hour work is by NPC permission only (as authorized).
  • Compliance with Laws and Acts – The Contractor shall comply with all federal, Provincial, and Municipal Laws, statutes, regulations, and bylaws, relevant to this RFP including but not limited to:
    • The Construction Lien Act, R.S.O. 1990, c. C.30
    • The Occupational Health and Safety Act, R.S.O. 1990, c. 0.1, as amended
    • Workplace Safety and Insurance Act, effective January 1, 1998, as amended
    • The Municipal Freedom of Information and Protection of Privacy Act, R.S.O. 1990, c. M.56, as amended
  • Codes and Standards – Materials and workmanship shall comply with the requirements of the National Building Code of Canada (NBC), Ontario Building Code (OBC), Construction Safety Act, local building bylaws, and applicable standards of Canada Standards Association (CSA), American Society for Testing Materials (ASTM), Canadian General Standards Board (CGSB), American Standards Association (ASA), Canadian Electrical Manufacturers Association (CEMA), National Fire Protection Association (NFPA), and other relevant Codes and Standards. In particular, conform to the requirements of Ontario Occupational Health and Safety Act and Regulations for Construction Projects and Industrial Establishments.
  • Where Codes or Standards of this Specification does not provide all information necessary for complete installation of an item, and then strictly with the manufacturer’s instructions for first quality workmanship. In cases of discrepancies, consult the NPC for clarification.
  • In the event of conflict between any provisions of relevant Codes and Standards, the requirements of authority having jurisdiction apply.

Notes:

  1. The NPC reserves the right to conduct random “spot checks” on all successful vendors of record (VOR) to monitor service compliance with NPC’s health, safety and environmental policies & procedures.
  2. The NPC shall conduct annual appraisals on all successful VOR’s for Health & Safety compliance and work performance as per terms of the VOR contract obligations.
